Humanitarian Parole Fact Sheet

Humanitarian parole allows individuals who are otherwise inadmissible to enter the United States temporarily because of emergency humanitarian reasons. While it does not grant permanent immigration status, a beneficiary is allowed to apply for and receive employment authorization. It is rarely granted for longer than one year, but extensions can be filed. Anyone may file for humanitarian parole on behalf of the prospective parolee. DHS Announces Initiatives to Enhance E-Verify

Department of Homeland Security (DHS) Secretary Janet Napolitano joined with USCIS Director Alejandro Mayorkas to announce a number of initiatives to improve the E-verify system. These include a new agreement with the Department of Justice (DOJ) that will simplify the adjudication process for E-Verify cases involving misuse and discrimination; an informational hotline for workers seeking E-Verify information; and new training videos explaining E-Verify procedures and policies, as well as employee rights and employer responsibilities in English and Spanish. USCIS Guidelines for Expedite Requests

USCIS has published information regarding its criteria for requests to expedite cases.  All expedite requests are considered on a case-by-case basis and granted at the discretion of the Director.  To merit expedited treatment, the applicant of petitioner must demonstarte one or more of the following:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS

The applicant or petitioner must include a written explanation stating the reasons for expedited treatment and the words “EXPEDITE REQUEST” must be written at the top of the letter.  Requests to expedite pending applications and petitions may be directed to the National Customer Service Center (NCSC), made through an InfoPass appointment at a local USCIS office, or submitted through a letter to the appropriate Service Center or local USCIS office.

USCIS Updates Form I-485 and Form I-360

On February 25, 2010, USCIS published revised Forms I-485 ( Application to Register Permanent Residence or Adjust Status) and I-360 (Petition for Amerasian, Widow(er), or Special Immigrant).  USCIS will accept the previous versions of Forms I-485 and I-360 until March 29, 2010.  After March 29, 2010, any previous versions of the the form will be rejected.
